ORDER

WHEREAS:

 

A.      On February 12, 2025, British Columbia Hydro and Power Authority (BC Hydro) filed an application (Application) with the British Columbia Utilities Commission (BCUC) pursuant to section 71 of the Utilities Commission Act (UCA) for acceptance of ten electricity purchase agreements (EPAs) with the successful proponents of BC Hydro’s 2024 call to acquire clean or renewable electricity from greenfield generating facilities in British Columbia. The EPAs are:

a.       The Boulder and Elkhart Wind Project EPA between BC Hydro and Elkhart Wind Limited Partnership;

b.       The Brewster Wind Project EPA between BC Hydro and Brewster Wind Inc.;

c.       The Highland Valley Wind Project EPA between BC Hydro and Highland Valley Wind Inc.;

d.       The K2 Wind Project EPA between BC Hydro and K2 Wind Power Inc.;

e.       The Mount Mabel Wind Project EPA between BC Hydro and Mount Mabel Wind Inc.;

f.        The Nilhts’i Ecoener Wind Project EPA between BC Hydro and Nilhts'i Ecoener Energy Corp;

g.       The Nithi Mountain Wind Project EPA between BC Hydro and Nithi Mountain Power General Partnership;

h.       The ShTSaQU Solar Project EPA between BC Hydro and Logan BC Solar Project Limited Partnership;

i.         The Stewart Creek Wind Project EPA between BC Hydro and Stewart Creek Power Inc.; and

j.         The Taylor Wind Project EPA between BC Hydro and Taylor Wind Project Inc.;

B.      By Order G-51-25 dated February 26, 2025, the BCUC established a regulatory timetable for review of the Application which included, among other things, one round of BCUC information requests, letters of comment, responses to letters of comment and final argument;

C.      On March 17, 2025, the BCUC received a letter of comment (K'ómoks Letter of Comment) dated March 18, 2025, from K'ómoks First Nation (K'ómoks), in which K'ómoks, among other things, requests that the BCUC:

a.       require BC Hydro to file all information and records related to BC Hydro’s direct engagement with K'ómoks, if any, and respond to certain listed questions; and

b.       amend the regulatory timetable to include additional process steps; and

D.      The BCUC has reviewed the K'ómoks Letter of Comment and determines that an amended regulatory timetable is warranted.

 

NOW THEREFORE the BCUC orders as follows:

 

1.       The regulatory timetable is amended, as set out in Appendix A to this order.

2.       BC Hydro is directed to provide a response to the K'ómoks Letter of Comment by Monday, March 24, 2025, including, at a minimum, responses to:

a.       the questions raised by K'ómoks in the letter; and

b.       the potential additional process steps proposed by K'ómoks in the letter.
