ORDER
WHEREAS:
A. On April 16, 2025, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to section 41 and sections 59 to 61 of the Utilities Commission Act, for approval to discontinue operation of the Vedder Transport Ltd. (Vedder) Liquefied Natural Gas (LNG) fueling station located in Abbotsford, BC (Vedder Abbotsford Fueling Station) and to cancel or rescind certain tariff supplements between FEI and LNG fueling services customers at the Vedder Abbotsford Fueling Station (Application);
B. By Order C-11-12A dated June 11, 2013, the BCUC granted FEI a Certificate of Public Convenience and Necessity for the construction and operation of the Vedder Abbotsford Fueling Station;
C. In the Application, FEI states that on April 26, 2024, FEI decommissioned all of the equipment at the Vedder Abbotsford Fueling Station and it is no longer operational or in service;
D. FEI also seeks approval to cancel or rescind four tariff supplements (TS) for LNG fueling services at the Vedder Abbotsford Fueling Station:
1. LNG Fueling Station Installation and Operation Agreement dated March 2, 2012, between Vedder and FEI, approved by Order G-22-14 (TS J-3);
2. Amended and Restated Fueling Services Agreement dated April 24, 2020, between Ledcor LNG Group Ltd. (Ledcor) and FEI, approved by Order G-113-20 (TS J-9);
3. Amended and Restated Fueling Services Agreement dated June 1, 2020, between Commercial Logistics Inc. (Commercial Logistics) and FEI, approved by Order G-144-20 (TS J-27); and
4. Fueling Services Agreement dated February 7, 2020, between Ken Johnson Trucking Ltd. (Ken Johnson) and FEI, approved by Order G-23-20 (TS J-54); and
E. The BCUC has commenced review of the Application and finds that the establishment of a regulatory timetable is warranted.
NOW THEREFORE the BCUC orders as follows:
1. A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.
2. FEI is directed as soon as reasonably possible, but no later than May 14, 2025, to provide notice of this Application and a copy of this order, electronically where possible, to Vedder, Ledcor, Commercial Logistics, and Ken Johnson.
3. FEI is directed to provide to the BCUC, by May 16, 2025, confirmation of compliance with the notice requirements set out in Directive 2, and a list of those notified.
4. In accordance with BCUC’s Rules of Practice and Procedure, any party wishing to comment on the Application is invited to submit a letter of comment by the date established in the regulatory timetable. Letters of comment must be in the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.
