ORDER
WHEREAS:
A. On April 2, 2025, Tidewater Midstream and Infrastructure Ltd. (Tidewater) filed a complaint (Complaint) with the British Columbia Utilities Commission (BCUC) regarding the calculation by Plateau Pipe Line Ltd., a wholly-owned subsidiary of Pembina Pipeline Corporation (Plateau) of the final tolls to be charged to Tidewater by Plateau for the 2022-2024 contract years on the northern segment of the western pipeline system;
B. By letter dated May 5, 2025, Tidewater and Plateau jointly requested that the BCUC hold the proceeding to review the Complaint in abeyance and take no further steps to adjudicate it to allow the parties to pursue a commercial resolution of the issues raised in the matter (Abeyance Request). Tidewater stated that if the Abeyance Request is granted, it would undertake to update the BCUC regarding the parties’ intentions by no later than September 1, 2025; and
C. The BCUC has reviewed the Abeyance Request and considers the following determinations to be warranted.
NOW THEREFORE the BCUC orders as follows:
1. Tidewater is directed to provide an update regarding Tidewater and Plateau’s efforts to reach a commercial resolution to the issues raised in the Complaint by no later than September 1, 2025.
2. The proceeding is adjourned pending the filing of Tidewater’s update pursuant to Directive 1 above.
