ORDER

WHEREAS:

 

A.      On February 12, 2025, British Columbia Hydro and Power Authority (BC Hydro) filed an application (Application) with the British Columbia Utilities Commission (BCUC) pursuant to section 71 of the Utilities Commission Act (UCA) for acceptance of ten electricity purchase agreements (EPAs) with the successful proponents of BC Hydro’s 2024 call to acquire clean or renewable electricity from greenfield generating facilities in British Columbia;

B.      By Orders G-51-25, G-72-25, and G-114-25, dated February 26, 2025, March 19, 2025, and May 7, 2025, respectively, the BCUC established and amended the regulatory timetable for review of the Application, which included, among other things, one round of BCUC information requests (IRs), letters of comment,
BC Hydro’s response to K'ómoks First Nation’s (K'ómoks) request for access to certain IR responses which
BC Hydro filed on a confidential basis (Access Request), and K'ómoks’s reply, if necessary, to BC Hydro’s response to the K'ómoks Access Request, with further process to be determined;

C.      On May 10, 2025, K'ómoks filed a letter submitting Confidentiality Declaration and Undertaking Forms and raising concerns regarding a May 9, 2025 call (May 9 Call) from BC Hydro counsel to a K'ómoks representative regarding the Access Request, among other things;

D.      On May 12, 2025, BC Hydro filed its response to the K'ómoks Access Request, providing the confidential information requested by K'ómoks without addressing K'ómoks’s comments regarding the May 9 Call; and

E.       The BCUC has reviewed the submissions to date and determines that an amended regulatory timetable is warranted.

 

NOW THEREFORE the BCUC orders that the regulatory timetable is amended, as set out in Appendix A to this order.
