ORDER
WHEREAS:
A. On July 22, 2025, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval of the rates established in a fuelling services agreement between FEI and Nortrans Freight Management Ltd. (Nortrans) for compressed natural gas (CNG) fuelling service from the fuelling station located at Environmental 360 Solutions Ltd.’s (E360S) property in Kelowna, BC (E360S Fuelling Station) (Nortrans-E360S Agreement) on a permanent basis, effective July 29, 2025 (Application);
B. By Order G-158-22, dated June 10, 2022, the BCUC approved:
(i) On a permanent basis, effective October 1, 2019, the rate design and rates established for E360S in the Fueling Equipment Licence and Use Agreement between FEI and E360S, the amending agreement dated May 21, 2019, and the amending agreement dated August 18, 2021; and
(ii) On a permanent basis, effective July 31, 2020, the amending agreement dated June 12, 2020;
C. On July 21, 2025, FEI and Nortrans entered into the Nortrans-E360S Agreement which establishes the terms, conditions and rates for Nortrans to receive CNG fuelling services from the E360S Fuelling Station, effective July 29, 2025. FEI states that the rates established in the Nortrans-E360S Agreement are consistent with the rates approved by Order G-158-22; and
D. The BCUC has reviewed the Application and considers that approval of the proposed rates established for Nortrans in the Nortrans-E360S Agreement on a permanent basis is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established for Nortrans in the Nortrans-E360S Agreement are approved on a permanent basis, effective July 29, 2025.
2. FEI is to file the Nortrans-E360S Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
