ORDER
WHEREAS:
A. On June 23, 2025, FortisBC Energy Inc. (FEI) filed tariff pages for British Columbia Utilities Commission (BCUC) endorsement, which included, among other things, a revised capital rate for public compressed natural gas (CNG) fuelling services at the fuelling station located on Annacis Island in Delta, BC (Annacis Island Fuelling Station) under Rate Schedule 6P – Public Service – Natural Gas Refuelling Service (RS 6P), effective July 1, 2025;
B. On July 21, 2025, FEI filed tariff pages for BCUC endorsement, which included, among other things, the revised capital rate set out in the tariff pages filed on June 23, 2025 and a revised operations and maintenance (O&M) rate, effective July 1, 2025. The capital rate and O&M rate are components of the Station Service Related Charges for public CNG fuelling services at the Annacis Island Fuelling Station under RS 6P;
C. By Order G-313-21 dated November 1, 2021, the BCUC, among other things, consented to FEI’s proposed amendments and rates to RS 6P for public fuelling service at the Annacis Island Fuelling Station on an interim and non-refundable or non-recoverable basis, effective November 30, 2021;
D. By Order G-225-22 dated August 12, 2022, the BCUC, among other things, directed FEI to file amended RS 6P tariff pages reflecting the annual escalation of the O&M and capital rates, within 90 days of the anniversary of the Annacis Island Fuelling Station’s rate change date, to ensure that the public fuelling rates in RS 6P remain consistent with the rates for other users of the stations;
E. By Order G-198-23 dated July 25, 2023, the BCUC approved the use of the rate design and rates established for the anchor customers for fuelling services at the Annacis Island Fuelling Station, on a permanent basis, effective January 18, 2022. The BCUC also directed FEI to file an application with the BCUC seeking rates for public fuelling at the Annacis Island Fuelling Station under RS 6P on a permanent basis within 90 days of the date of Order G-198-23;
F. By Order G-32-24 dated February 6, 2024, the BCUC consented to the rates in RS 6P for public fuelling service at the Annacis Island Fuelling Station, on a permanent basis, effective November 30, 2021;
G. By Order C-4-25 dated May 2, 2025, the BCUC, among other things, granted FEI a Certificate of Public Convenience and Necessity to expand the Annacis Island Fuelling Station and approved the amended rate design and rates established for the anchor customers of the station to account for the expansion, on an interim and refundable/recoverable basis, effective July 1, 2025;
H. On August 5, 2025, in response to BCUC staff questions, FEI confirmed that by filing the June 23, 2025 and July 21, 2025 tariff pages for BCUC endorsement, it is requesting BCUC approval of the rates in RS 6P as set out in the July 21, 2025 tariff pages for public fuelling service at the Annacis Island Fuelling Station, on an interim basis, effective July 1, 2025. FEI also confirmed that the requested rates in RS 6P for the Annacis Island Fueling Station are consistent with the rates approved by Order C-4-25 for the anchor customers of the station; and
I. The BCUC has reviewed the June 23, 2025 and July 21, 2025 tariff pages and the response to BCUC staff questions dated August 5, 2025, and considers that the following determinations are warranted.
NOW THEREFORE pursuant to sections 59 to 61 and 89 of the Utilities Commission Act, the BCUC orders as follows:
1. The BCUC approves the rates in RS 6P, for public fuelling service at the Annacis Island Fuelling Station, as set out in the July 21, 2025 tariff pages, on an interim basis, effective July 1, 2025. Any variance between the interim rates and the permanent rates will not be refundable to or recoverable from customers under RS 6P.
2. The July 21, 2025 tariff pages for public fuelling at the Annacis Island Fuelling Station under RS 6P are accepted as filed.
