ORDER
WHEREAS:
A. On August 8, 2025, Creative Energy Vancouver Platforms Inc. (Creative Energy) filed an application for approval with the British Columbia Utilities Commission (BCUC), pursuant to sections 58 to 60 and 90 of the Utilities Commission Act, seeking, among other things, approval of rates, effective January 1, 2026, for the provision of cooling service to customers connected to its South Downtown district cooling system (SODO DCS) (Application);
B. By Order G-222-21 dated July 22, 2021, the BCUC approved, among other things, the rates and rate design for Creative Energy’s SODO DCS consisting of a levelized capacity charge per kilowatt (kW) per month and a variable charge per megawatt hour (MWh), effective November 23, 2020;
C. In the Application, Creative Energy requests approval of the following levelized capacity charge rates for the SODO DCS, as set out in Appendix B of the Application: $12.15 per kW per month, effective January 1, 2026 to December 31, 2026, and $13.65 per kW per month, effective January 1, 2027 to December 31, 2027;
D. Creative Energy also requests approval to continue charging the variable charge to customers on a flow-through basis, to continue using the Revenue Deficiency Deferral Account, and to terminate the Regulatory Cost Variance Deferral Account and the Generic Cost of Capital Variance Deferral Account by the end of 2025; and
E. The BCUC has commenced its review of the Application and considers that the following determinations are warranted.
NOW THEREFORE the BCUC orders as follows:
1. A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.
2. Creative Energy is directed to file supplemental information to the Application specified by the BCUC in accordance with the regulatory timetable set out in Appendix A to this order.
3. On or before Wednesday, September 3, 2025, Creative Energy is directed to:
(i) Provide notice of the Application and this order on its website at https://creative.energy/;
(ii) Provide a copy of the Application and this order, electronically where possible, to all customers of the SODO DCS, including, but not limited to, Westbank Projects Corp. as the building owner of Buildings 1, 3, and 4 and the strata corporation for Building 2;
(iii) Provide a copy of the Application and this order, electronically where possible, to all registered interveners in the Creative Energy Application for Heating Rates for the Heating Thermal Energy System and Cooling Rates for the District Cooling System at the Vancouver House Development proceeding that resulted in Order G-222-21; and
(iv) Provide notice of the Application and this order, or post the Public Notice attached as Appendix B to this order, on its existing social media platforms. Reminder posts must be published on each platform every two weeks until Wednesday, September 24, 2025.
4. Creative Energy is directed to provide to the BCUC:
(i) By Monday, September 8, 2025, confirmation of compliance with the public notice requirements in Directive 3 of this order, except for the social media reminder posts, including a list of social media platforms on which notice was posted and a list of all parties notified; and
(ii) By Monday, September 29, 2025, confirmation of compliance with the public notice requirement in Directive 3 of this order regarding social media reminder posts.
5. In accordance with the BCUC Rules of Practice and Procedure, parties who wish to actively participate in this proceeding must complete a Request to Intervene Form, available on the Get Involved in a Proceeding tab on the BCUC website at https://www.bcuc.com/forms/RequestToIntervene, by Wednesday, September 24, 2025.

CREATIVE ENERGY 2026 TO 2027 RATES FOR COOLING AT SOUTH DOWNTOWN
On August 8, 2025, Creative Energy Vancouver Platforms Inc. (Creative Energy) filed an application seeking the
British Columbia Utilities Commission’s (BCUC) approval to increase cooling rates for the years 2026 and 2027 for customers connected to its South Downtown district cooling system. Creative Energy proposes rates of $12.15 per kilowatt (kW) per month for 2026 and $13.65 per kW per month for 2027, an increase of approximately 12 percent per year.
The BCUC has established an open and transparent public proceeding to review Creative Energy’s application to determine permanent rates, among other items. The proceeding includes several opportunities for public comment and participation:
