ORDER
WHEREAS:
A. On August 5, 2025, Creative Energy Thompson Rivers Limited Partnership (CE Thompson Rivers) filed an application (Application) with the British Columbia Utilities Commission (BCUC) for approval of, among other things:
i. Creative Energy Building Retrofits Limited Partnership (CE Building Retrofits) acquiring a reviewable interest in CE Thompson Rivers, pursuant to section 54 of the Utilities Commission Act (UCA);
ii. CE Thompson Rivers registering on its books the transfer of all of its partnership units from Creative Energy Ventures Limited Partnership to CE Building Retrofits, pursuant to section 54 of the UCA; and
iii. CE Thompson Rivers entering into a security agreement with Canada Infrastructure Bank, pursuant to section 52 of the UCA, in respect of the obligations of CE Building Retrofits (as borrower) to Canada Infrastructure Bank (as lender) under a credit agreement among these parties and Creative Energy Building Retrofits GP Ltd. dated April 25, 2025;
B. In the Application, CE Thompson Rivers states that it is a public utility pursuant to the UCA, which will undertake the construction, ownership, maintenance and operation of a low-carbon district energy system at the Thompson Rivers University campus in Kamloops, BC; and
C. The BCUC finds that the establishment of a public hearing to review the Application is warranted.
NOW THEREFORE the BCUC orders as follows:
1. A public hearing process is established for the review of the Application, as set out in the regulatory timetable attached as Appendix A to this order.
2. On or before Wednesday, September 3, 2025, CE Thompson Rivers is directed to:
i. Provide notice of the Application and this order on its website at: https://creative.energy/; and
ii. Provide notice of the Application and this order on its existing social media platforms.
3. CE Thompson Rivers is directed to provide to the BCUC by Friday, September 5, 2025, confirmation of compliance with Directive 2 of this order, including a list of social media platforms on which notice was provided.
4. In accordance with BCUC’s Rules of Practice and Procedure, any party wishing to provide comments is invited to submit a Letter of Comment by the date established in the regulatory timetable. Letters of comment must be in the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.
