Gas Sales Agreement with Terus Construction

ORDER

WHEREAS:

 

A.      On July 30, 2025, Pacific Northern Gas Ltd. (PNG) filed an application with the British Columbia Utilities Commission (BCUC) pursuant to Sections 59 to 61 of the Utilities Commission Act (UCA) for approval of a gas sales agreement (GSA) to provide natural gas service to Terus Construction (Terus) for its industrial aggregate and construction facilities located in Smithers, British Columbia (PNG-Terus GSA).

B.       Terus is relocating its Smithers facilities to a new site which requires the installation of a new service line. The terms and conditions of the PNG-Terus GSA provide for the full recovery of the capital cost associated with the new service line over the term of the agreement.

C.       On August 18, 2025, the BCUC issued a staff question to PNG seeking clarification on the “Commencement Date” as defined in the PNG-Terus GSA. PNG stated that despite lack of reference to the BCUC approval of the PNG-Terus GSA, the GSA will not come into force until BCUC approval has been granted. PNG stated that the definition of the “Commencement Date” in the form of GSA should be amended to also refer to the BCUC approval date.

D.      The BCUC has reviewed the Application and finds the following determinations are warranted.

NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:

 

1.       The PNG-Terus GSA, inclusive of Schedules A and B, is approved effective as of the date of this order.

2.       PNG is directed to file with the BCUC updated tariff pages for endorsement reflecting the above approvals within 15 days of the issuance of this order.
