GFL Environmental Inc. Abbotsford Fuelling Station

ORDER
WHEREAS:
A. On August 22, 2025, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act for approval of the rates established in a fuelling services agreement between FEI and Halton Recycling Ltd. D.B.A. Emterra Environmental (Emterra) (FEI-Emterra Agreement) for compressed natural gas (CNG) fuelling service at the fuelling station constructed for GFL Environmental Inc. (GFL) in Abbotsford, BC (GFL Abbotsford Fuelling Station) on a permanent basis, effective September 1, 2025 (Application);
B. By Order G-116-22, the BCUC, among other things, determined that the GFL Abbotsford Fuelling Station met the requirements for a prescribed undertaking as defined by the Greenhouse Gas Reduction (Clean Energy) Regulation;
C. By Order G-37-24 dated February 12, 2024, the BCUC approved the rate design and rates established in the fuelling services agreement between FEI and GFL (GFL Abbotsford Agreement) as amended, on a permanent basis, effective November 15, 2021, for GFL to receive CNG fuelling services from the GFL Abbotsford Fuelling Station;
D. On August 20, 2025, FEI and Emterra entered into the FEI-Emterra Agreement which establishes the terms, conditions and rates for Emterra to receive CNG fuelling services from the GFL Abbotsford Fuelling Station, effective September 1, 2025. FEI states that the FEI-Emterra Agreement reflects the rates that are currently approved for all customers receiving CNG fuelling service from the GFL Abbotsford Fuelling Station; and
E. The BCUC has reviewed the Application and makes the following determinations.
NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act the BCUC orders as follows:
1. The rates established for Emterra in the FEI-Emterra Agreement are approved on a permanent basis, effective September 1, 2025.
2. FEI is directed to file the FEI-Emterra Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
