Housekeeping Amendments to Rules and Guidelines

ORDER

WHEREAS:

 

A.      The British Columbia Utilities Commission (BCUC) may employ a secretary, pursuant to section 7(1)(b) of the Utilities Commission Act (UCA), whose duties include keeping records of proceedings before the BCUC, as well as records of any rules, regulations, and orders issued by the BCUC, pursuant to section 10 of the UCA;

B.      The BCUC’s jurisdiction to make rules respecting its practice and procedure is set out in section 11 of the Administrative Tribunals Act (ATA), which provides  

Subject to an enactment applicable to the tribunal, the tribunal has the power to control its own processes and may make rules respecting practice and procedure to facilitate the just and timely resolution of the matters before it;

C.      The BCUC has updated the position formerly known as “Commission Secretary” to that of “Registrar”; and

D.      The BCUC considers that housekeeping amendments to various rules and guidelines are required to reflect this change, and finds the following determinations are warranted.

 

NOW THEREFORE pursuant to sections 2.1 and 99 of the UCA and section 11 of the ATA, the BCUC orders as follows:

 

1.       The following orders and letter are amended by replacing references to the “Commission Secretary” with references to the “Registrar”, and replacing references to the Commission Secretary’s contact information with the Registrar’s contact information:

a.       Order G-192-25 establishing the BCUC’s Rules of Practice and Procedure, the Confidentiality Declaration and Undertaking Form, the Participant Cost Award (PCA) Application Form, and the Interim PCA Application Form;

b.       Order G-126-23 establishing the Cybersecurity Framework for Public Utilities;

c.       Order G-52-24 establishing the Public Utility Safety Guidelines;

d.       Order G-37-12 establishing the BCUC’s Streamlined Review Process;

e.       Order G-48-25 establishing the Thermal Energy System (TES) Guidelines, including the Appendices A to E establishing the guidelines for Strata TES, Micro TES, Fixed-Scale TES, Affiliated Fixed-Scale TES, and District TES;

f.        Order G-20-15 establishing the Certificate of Public Convenience and Necessity Application Guidelines;

g.       Order G-51-10 establishing the First Nations Information Filing Guidelines for Crown Utilities;

h.       Order G-11-12 establishing the BCUC’s Negotiated Settlement Process;

i.         Order G-52-24 establishing the Annual Safety Declaration for Public Utilities;

j.         Order G-14-22 establishing the Fuel Price Transparency Act Confidentiality Declaration and Undertaking Form; and

k.       Letter L-18-09 establishing the BCUC’s Regulatory Filing Guidelines.
