ORDER
WHEREAS:
A. On June 3, 2025, Pacific Northern Gas (N.E.) Ltd. (PNG(NE)) filed an application (Application) with the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), requesting approval of amendments to Tariff Supplement No. 3 – Service Agreement Between PNG(NE) and Canadian Natural Resources Limited (CNRL)(Service Agreement);
B. By Order G-56-07 dated May 29, 2007, the BCUC accepted the service agreement between PNG(NE) and CNRL, effective January 1, 2007;
C. In the Application, PNG(NE) states that certain amendments to the Service Agreement are required to reflect changes to the composition of gas supplied at the Tumbler Ridge gas processing plant and associated service terms;
D. By Order G-160-25, the BCUC established a regulatory timetable which included PNG(NE) providing notice of the Application to CNRL, one round of BCUC Information requests (BCUC IR No.1) and letters of comment;
E. On July 17, 2025, the BCUC issued BCUC IR No.1 and on August 1, 2025, PNG(NE) filed its response;
F. The BCUC did not receive any letters of comment during the proceeding;
G. On August 20, 2025, the BCUC issued a Request for Supplemental Information to PNG(NE), requesting that PNG(NE) provide an update on its current negotiations with CNRL and to provide an executed amended Service Agreement, if available. The Panel also requested that PNG(NE) address in its final argument why the BCUC should approve a rate based on an unexecuted agreement between two parties in this instance;
H. On August 29, 2025, PNG(NE) filed its response to the BCUC’s Request for Supplemental Information and on September 2, 2025, PNG(NE) filed its final argument; and
I. The BCUC has completed its review of the Application, evidence, and submissions filed in the proceeding, and makes the following determinations.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The amended Service Agreement is approved as filed.
2. PNG(NE) is directed to file the amended Service Agreement for endorsement by the BCUC within 30 days of the date of this order.
