ORDER
WHEREAS:
B. By Orders G-72-17 and G-73-17 dated May 17, 2017, the BCUC approved the rate design and rates established in compressed natural gas (CNG) fuelling services agreements between FEI and its two anchor customers, Canadian Linen & Uniform Services Co. (Canadian Linen) and Disposal Queen, for CNG fuelling service from the fuelling station on FEI’s property in Burnaby, British Columbia (Burnaby Operations Fuelling Station) on a permanent basis, effective July 1, 2016;
C. By Order G-264-23 dated October 10, 2023, the BCUC approved the rate design and rates in a new fuelling service agreement with Canadian Linen dated June 1, 2023, as amended, for Canadian Linen to continue receiving CNG fuelling service from the Burnaby Operations Fuelling Station, effective July 1, 2023 (Canadian Linen-Burnaby Operations Agreement). The rates established in the Canadian Linen-Burnaby Operations Agreement are consistent with the rates approved by Orders G-72-17 and G-73-17;
D. On September 4, 2025, FEI and Disposal Queen entered into Amending Agreement No. 1 to extend the expiry date of the Disposal Queen-Burnaby Operations Agreement from December 31, 2025 to June 30, 2028 on the existing terms, conditions and rates. FEI states that the amended expiry date aligns with the Canadian Linen-Burnaby Operations Agreement’s expiry date; and
E. The BCUC has reviewed the Application and considers that the following determinations are warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act, the BCUC orders as follows:
1. The rates established for Disposal Queen in the Disposal Queen-Burnaby Operations Agreement as amended by Amending Agreement No. 1 are approved on a permanent basis, effective January 1, 2026.
2. FEI is to file Amending Agreement No. 1 in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
