ORDER

WHEREAS:

 

A.      On August 26, 2025, pursuant to section 71 of the Utilities Commission Act, FortisBC Energy Inc. (FEI) filed with the British Columbia Utilities Commission (BCUC) an executed three-year firm gas storage agreement (Agreement) between FEI and AECO Gas Storage Partnership, by its managing partner Rockpoint Gas Storage Canada Ltd. (Rockpoint) for the period of April 1, 2026 to March 31, 2029 (Filing);

B.      The Filing states that the Agreement was made pursuant to the Storage Services Agreement between AECO Gas Storage Partnership and FEI dated October 5, 2005 (Storage Services Agreement);

C.      By Order G-130-06 dated October 27, 2006, the BCUC established the Rules for Natural Gas Energy Supply Contracts (Rules). Appendix A of Order G-130-06 contains the Rules, which are intended to facilitate the BCUC’s review of natural gas energy supply contracts;

D.      By Letter L-7-25 dated May 29, 2025, the BCUC accepted FEI’s Annual Contracting Plan for the 2025/2026 gas year commencing November 1, 2025 and ending October 31, 2026;

E.       On October 3, 2025, FEI filed with the BCUC an erratum to the Filing containing a revised version of the Agreement to correct the reference to the execution date of the Storage Services Agreement, which now reads as October 5, 2010 (Revised Agreement);

F.       FEI requests that the Filing remain confidential in perpetuity due to its commercially sensitive nature; and

G.      The BCUC has reviewed the Filing and finds the following determinations are warranted.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Rules, the BCUC orders as follows:

 

1.       The Revised Agreement between FEI and Rockpoint is accepted as filed.

2.       The Filing will be kept confidential unless the BCUC determines otherwise.
