ORDER
WHEREAS:
A. On December 2, 2025, Creative Energy Sen̓áḵw Limited Partnership (CESLP) applied to the British Columbia Utilities Commission (BCUC) pursuant to sections 59 to 61 of the Utilities Commission Act for approval of, among other things, the proposed rates and rate design to provide thermal energy services from the Sen̓áḵw Thermal Energy System from March 1, 2026 to December 31, 2027 (Application);
B. By Order C-5-23 dated October 26, 2023, the BCUC granted CESLP a certificate of public convenience and necessity authorizing the construction and operation of the Sen̓áḵw Thermal Energy System to provide space heating, space cooling and domestic hot water to phases 1 and 2 of the Sen̓áḵw development; and
C. The BCUC has commenced its review of the Application and finds that the following determinations are warranted.
NOW THEREFORE the BCUC orders as follows:
1. A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.
2. By Monday, December 22, 2025, CESLP is directed to:
a. Provide electronically where possible, a copy of the Application and this order to the registered interveners in CESLP’s 2023 Certificate of Public Convenience and Necessity for the Sen̓áḵw District Energy System proceeding, Nch’ḵay̓ Development Corporation, OPTrust, and any known prospective tenants of the Sen̓áḵw development;
b. Provide a copy of the Application and this order on CESLP’s and Creative Energy Vancouver Platforms Inc.’s (Creative Energy) websites, as applicable; and
c. Publish Public Notice, attached as Appendix C to this order, on each of CESLP’s and Creative Energy’s relevant and existing social media platforms, as applicable. Weekly reminder posts must be posted on each platform until the conclusion of the intervener registration period on Thursday, January 8, 2026.
3. CESLP is directed to provide to the BCUC:
a. By Tuesday, December 23, 2025, confirmation of compliance with the public notice requirements in Directive 2 of this order, except for the social media reminder posts, including a list of social media platforms on which notice was posted and a list of all parties notified; and
b. By Friday, January 9, 2026, confirmation of compliance with the public notice requirement in Directive 2 of this order regarding social media reminder posts.
4. CESLP is directed to provide the supplemental information as outlined in Appendix B to this order by Tuesday, December 23, 2025.

SUPPLEMENTAL INFORMATION
1. Please confirm, or explain otherwise, that the Terms and Conditions (T&Cs) as filed in Exhibit A2-1 of this proceeding represent CESLP’s most current version of the T&Cs for providing thermal energy service from the Sen̓áḵw Thermal Energy System. If not confirmed, please file the current version of the T&Cs.
2. Please confirm, or explain otherwise, that CESLP is seeking approval of the proposed rates as defined by:
a. The Tariff Pages filed in Appendix B to the Application; and
b. The T&Cs as filed in Exhibit A2-1 or as provided in response to item 1 above.[1]
Creative Energy Sen̓áḵw 2026-2027 Rates and Rate Design
On December 2, 2025, Creative Energy Sen̓áḵw Limited Partnership (CESLP) filed an application with the British Columbia Utilities Commission (BCUC) to establish rates and a rate design for the new Sen̓áḵw Thermal Energy System. The system will provide heating and cooling to newly constructed buildings in the Sen̓áḵw development in Kitsilano, Vancouver.
CESLP is seeking approval of heating and cooling rates and a rate design for Sen̓áḵw development customers for 2026 and 2027, effective March 1, 2026, and January 1, 2027.
