Regulatory Costs Deferral Account

ORDER
WHEREAS:
A. On December 10, 2025, Kyuquot Power Ltd. (KPL) filed with the British Columbia Utilities Commission (BCUC) an application seeking approval to create a rate base deferral account to record future regulatory costs related to BCUC proceedings (Application);
B. By Decision and Order G-225-25 dated September 16, 2025 (2025 Decision), the BCUC approved KPL to increase its Basic and Energy Charges effective the date of that order. In the 2025 Decision, the BCUC also directed KPL to indicate, in a compliance filing, whether it will apply to the BCUC for approval to establish a deferral account to record all future regulatory costs related to BCUC proceedings;
C. On October 30, 2025, KPL filed its compliance filing as required by Directive 6 of Order G-225-25. On November 13, 2025, the BCUC issued Staff Information Request No. 1 on KPL’s compliance filing. On December 9, 2025, in response to the BCUC’s Staff Information Request No. 1, KPL indicated that it intended to initiate an application for a deferral account to record all future regulatory costs related to BCUC proceedings before December 12, 2025; and
D. The BCUC has commenced its review of the Application and considers that establishing a regulatory timetable is warranted.
NOW THEREFORE the BCUC orders as follows:
1. The regulatory timetable for the review of the Application is established as set out in Appendix A to this order.
2. KPL is directed to post the Application and this order on its website at https://kyuquotpower.com by Thursday, January 22, 2026.
3. KPL is directed to provide written confirmation of compliance with the public notice requirement set out in Directive 2 of this order on or before Monday, January 26, 2026.
4. In accordance with the BCUC Rules of Practice and Procedure, any party wishing to comment on the Application is invited to submit a Letter of Comment by the date established in the regulatory timetable. Letters of comment must be in the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.

KYUQUOT POWER REGULATORY COSTS DEFERRAL ACCOUNT APPLICATION
In December 2025, Kyuquot Power Ltd. filed with the British Columbia Utilities Commission (BCUC) an application for approval to create a deferral account to record future regulatory costs related to BCUC proceedings.
Kyuquot Power states that a regulatory costs deferral account will provide it with greater certainty for recovery of regulatory costs. The BCUC strongly encouraged Kyuquot Power to apply for a regulatory costs deferral account in its previous rates decision to enable the utility to manage these costs more appropriately in the future.
