ORDER
WHEREAS:
A. On December 19, 2025, British Columbia Hydro and Power Authority (BC Hydro) filed an application (Application) with the British Columbia Utilities Commission (BCUC) pursuant to section 71 of the Utilities Commission Act (UCA) for acceptance of:
i. An electricity purchase agreement (EPA) amendment agreement dated October 10, 2025, as between BC Hydro and Elkhart Wind Limited Partnership (Boulder Elkhart IPP) in respect of the Boulder Elkhart Wind Project EPA (Boulder Elkhart EPA); and
ii. An EPA amendment agreement dated November 27, 2025, as between BC Hydro and K2 Wind Power Inc. (K2 IPP) in respect of the K2 Wind Project EPA (K2 EPA);
B. On January 15, 2026, BC Hydro filed with the BCUC supplemental information to its Application to provide BC Hydro’s view on a proposed regulatory review process, clarify that engagement with First Nations continues with respect to the interconnection process for both the Boulder Elkhart IPP and the K2 IPP and inform the BCUC of a clerical omission with respect to providing notice of the Application to interested parties (Supplemental Information);
C. By Order G-61-12 dated May 25, 2012, the BCUC approved the Rules for Energy Supply Contracts for Electricity (Rules). Appendix A of Order G-61-12 contains the Rules, which are intended to facilitate the BCUC’s review of energy supply contracts for electricity, pursuant to section 71 of the UCA;
D. By Order E-8-25 dated August 25, 2025, the Boulder Elkhart EPA and K2 EPA were accepted by the BCUC;
E. In the Application, BC Hydro states that it has identified changes to the planned interconnections for the Boulder Elkhart EPA and the K2 EPA that will result in the construction of one BC Hydro substation, rather than two, to accommodate the interconnections of these independent power producers;
F. BC Hydro has filed both a redacted and unredacted version of the Application. BC Hydro requests that the unredacted version of the Application be held confidential due to its commercially sensitive nature; and
G. The BCUC has commenced review of the Application and considers a public hearing is warranted.
NOW THEREFORE the BCUC orders as follows:
1. A public hearing process is established for the review of the Application, as set out in the regulatory timetable attached as Appendix A to this order.
2. BC Hydro is directed to publish a copy of this order and the Application on its website and to provide a copy of this order and the Application, electronically where possible, to the following by no later than Thursday, February 5, 2026:
a. All registered interveners in the BC Hydro Fiscal 2023 to Fiscal 2025 Revenue Requirements Application proceeding; and
b. All First Nations identified by BC Hydro in the Application as within the consultative boundaries for the K2 Wind Project and the Boulder Elkhart Wind Project.
3. BC Hydro is directed to provide written confirmation to the BCUC of compliance with Directive 2 of this order, including a list of all parties notified, by no later than Tuesday, February 10.
4. In accordance with the BCUC’s Rules of Practice and Procedure, any party wishing to comment on the Application is invited to submit a Letter of Comment by the date established in the regulatory timetable. Letters of Comment must be submitted by way of the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.
