ORDER
WHEREAS:
A. On December 2, 2025, Creative Energy Sen̓áḵw Limited Partnership (CESLP) applied to the British Columbia Utilities Commission (BCUC) pursuant to sections 59 to 61 of the Utilities Commission Act for approval of, among other things, the proposed rates and rate design to provide thermal energy services from the Sen̓áḵw Thermal Energy System from March 1, 2026 to December 31, 2027 (Original Application);
B. By Order G-301-25 dated December 15, 2025, the BCUC established the regulatory timetable for the review of the Original Application which included, among other things, CESLP supplemental information, intervener registration, one round of BCUC and intervener information requests, and final and reply arguments;
C. On December 15, 2025, CESLP filed an errata to the Original Application with revised heating and cooling capacity charges reflecting the correction of three modelling errors and filed a corrected version of the application (Application). Appendix B of the Application proposes the following capacity charges, among other things:

D. On December 22, 2025, CESLP provided supplemental information confirming that the tariff pages for the Sen̓áḵw Thermal Energy System are represented by the rate schedule filed in Appendix B to the Application as well as the terms and conditions filed in Exhibit A2-1 with two revisions noted in Exhibit B-3; and
E. The BCUC is in the process of reviewing the Application and considers that the following determinations are warranted.
NOW THEREFORE pursuant to sections 59 to 61 and 89 of the Utilities Commission Act, the BCUC orders as follows:
1. CESLP is approved to implement the capacity charges as set out in Appendix B to the Application on an interim and refundable/recoverable basis, effective March 1, 2026.
2. CESLP is approved to implement the variable charges on a flow-through monthly basis to customers as set out in Appendix B to Application on an interim and refundable/recoverable basis, effective March 1, 2026.
3. The terms and conditions filed in Exhibit A2-1 as revised by the two revisions noted in Exhibit B-3 are approved, effective March 1, 2026.
4. CESLP is directed to file tariff pages with the BCUC for endorsement, reflecting the terms of this order, within 15 days of the date of this order.
