Interim Rates and Agreement for Nortrans Freight Management Ltd. for CNG Fuelling Service

at the Annacis Island Fuelling Station in Delta

ORDER

WHEREAS:

 

A.      On February 11, 2026, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC) pursuant to sections 59 to 61 and 89 of the Utilities Commission Act for approval of the rates established in a fuelling services agreement (FEI-Nortrans Agreement) between FEI and Nortrans Freight Management Ltd. (Nortrans) for compressed natural gas (CNG) fuelling service at the fuelling station located on Annacis Island in Delta, BC (Annacis Island Fuelling Station) on an interim and refundable/recoverable basis, effective February 20, 2026 (Application);

B.      By Order G-45-22 dated February 22, 2022, the BCUC determined, among other things, that the Annacis Island Fuelling Station met the requirements of a prescribed undertaking as defined by the Greenhouse Gas Reduction (Clean Energy) Regulation;  

C.      By Order C-4-25 dated May 2, 2025, the BCUC, among other things, granted FEI a Certificate of Public Convenience and Necessity to expand the Annacis Island Fuelling Station (2025 Expansion) and approved the amended rate design and rates established for the anchor customers of the station to account for the expansion, on an interim and refundable/recoverable basis, effective July 1, 2025;

D.      On January 13, 2026, FEI filed an application with the BCUC for approval of the rate design and rates for the anchor customers at the Annacis Island Fuelling Station, on a permanent basis, to reflect the completion of the 2025 Expansion and actual final capital costs. The BCUC is currently reviewing the application;

E.       On February 10, 2026, FEI and Nortrans entered into the FEI-Nortrans Agreement which established the terms, conditions and rates for Nortrans to receive CNG fuelling services from the Annacis Island Fuelling Station, effective February 20, 2026. FEI states that the rates in the FEI-Nortrans Agreement are consistent with the currently approved interim rates for the anchor customers of the station. FEI also states that it will apply for approval of permanent rates for Nortrans to receive CNG fuelling services from the Annacis Island Fuelling Station once the BCUC has determined the permanent rates for the anchor customers of the station; and

F.       The BCUC has reviewed the Application and considers that the following determinations are warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 and 89 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       The rates established for Nortrans in the FEI-Nortrans Agreement are approved on an interim and refundable/recoverable basis, effective February 20, 2026. 

2.       FEI is directed to file an application seeking permanent rates for Nortrans to receive CNG fuelling services from the Annacis Island Fuelling Station within 30 days of the BCUC issuing a final determination on the permanent rates for the anchor customers of the station.

3.       FEI is directed to refund to/recover from Nortrans any variance between the interim and permanent rates as determined by the BCUC following the final determination of the application seeking permanent rates for Nortrans to receive CNG fuelling service from the Annacis Island Fuelling Station, with interest calculated at the average prime rate of FEI’s principal bank for its most recent fiscal year.

4.       FEI is directed to file the FEI-Nortrans Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
