ORDER
WHEREAS:
A. On February 23, 2026, Creative Energy Vancouver Platforms Inc. (Creative Energy) filed a request with the British Columbia Utilities Commission (BCUC) to vary Directive 2 of Order G-298-25 to amend the approved refund plan for the 2025 year-end Fuel Cost Stabilization Account (FCSA) balance for the thermal energy system comprising the Core steam distribution network serving downtown Vancouver and the hot water distribution networks serving Northeast False Creek and the Butterfly Development (together, Core TES) (Application);
B. On November 19, 2025, Creative Energy filed an application with the BCUC for approval to refund or recover the expected 2025 FCSA balance by end of 2025 to Core TES customers on their first invoice in 2026. At the time, Creative Energy forecast a 2025 year-end balance in the FCSA of $95,990;
C. By Order G-298-25 dated December 12, 2025, the BCUC directed Creative Energy to refund or recover the expected 2025 FCSA balance with interest at the weighted average cost of debt of 5.31 percent, by end of 2025 to customers on their first invoice in 2026;
D. In the Application, Creative Energy advises the BCUC that it did not refund customers on their January 2026 invoices due to a material difference between the forecast FCSA balance of $95,990 and the actual FCSA balance of $674,859, and the operational implications of refunding the full amount in a single billing cycle. Creative Energy requests the BCUC amend Order G-298-25 to vary Directive 2 to allow Creative Energy to refund Core TES customers the 2025 FCSA balance over a 9-month period, commencing in March 2026 and ending in November 2026; and
E. The BCUC has commenced review of the Application and considers that the following determinations are warranted.
NOW THEREFORE the BCUC orders as follows:
1. A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.
2. By Tuesday, March 17, 2026, Creative Energy is directed to:
i. Publish the Application and this order on its website at https://creative.energy/;
ii. Provide a copy of the Application and this order, electronically where possible, to all customers of the Core TES; and
iii. Post the Public Notice attached as Appendix B to this order, on its existing social media platforms.
3. Creative Energy is to provide written confirmation to the BCUC that it has complied with Directive 2 by Thursday, March 19, 2026, including a list of the parties notified and the platforms on which notice of the Application was posted.
4. In accordance with the BCUC’s Rules of Practice and Procedure, any party wishing to comment on the Application is invited to submit a letter of comment by the date established in the regulatory timetable. Letters of comment must be in the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.

CREATIVE ENERGY VARIANCE OF ORDER G-298-25
On February 23, 2026, Creative Energy Vancouver Platforms Inc. (Creative Energy) applied to the British Columbia Utilities Commission (BCUC) for approval to vary Directive 2 of Order G-298-25 to amend the approved refund plan for the 2025 year-end Fuel Cost Stabilization Account balance. Creative Energy proposed that Directive 2 be varied to allow it to refund to customers the 2025 closing balance of the Fuel Cost Stabilization Account over a 9-month period, commencing in March 2026 and ending in November 2026.
