ORDER

WHEREAS:

 

A.      On November 30, 2020, Creative Energy Vancouver Platforms Inc. (Creative Energy) submitted its Northeast False Creek (NEFC) Rate Proposal and 2021 Revenue Requirements Application (RRA) to the British Columbia Utilities Commission (BCUC) seeking interim and permanent approval to increase NEFC hot water service rates by 10 percent (Application);

B.      Creative Energy proposes a “more limited hearing process” to promote regulatory efficiency and allow a timely BCUC decision ahead of the filing of the Creative Energy NEFC rate design application by June 2021; and

C.      The BCUC has commenced its review of the Application and determines that establishing an interim rate and regulatory timetable is warranted.

 

NOW THEREFORE the BCUC orders as follows:

 

1.       A 10 percent increase in the Creative Energy NEFC hot water service rates is approved on an interim and refundable/recoverable basis, effective January 1, 2021.

2.       A regulatory timetable is established, as set out in Appendix A to this order, which includes a request for affected customers and interveners (Affected Parties) in the Creative Energy 2019-2020 RRA for the Core Steam System and NEFC Service Areas proceeding to provide comments, if any, on the Application and submissions from Creative Energy and the Affected Parties on what, if any, regulatory process for the review of the Application would be appropriate and why.

3.       Creative Energy is directed to provide the public notice, attached as Appendix B to this order, to all affected customers and to all registered interveners in the Creative Energy 2019-2020 RRA for the Core Steam System and NEFC Service Areas by the date set out in the regulatory timetable attached as Appendix A.

4.       Creative Energy is directed to publish notice of the Application on its Twitter, LinkedIn and Facebook social media platforms on or before Wednesday, December 23, 2020 and must publish weekly reminder notices on each of these platforms until the conclusion of the comment process outlined in the regulatory timetable attached as Appendix A.

5.       Creative Energy is directed to make the Application available on Creative Energy’s website as soon as reasonably practicable.

6.       Any variance between the interim rates and permanent rates, as determined at the time the BCUC renders its final decision on the Application, will be refunded to or collected from ratepayers, with interest at a rate to be determined by the BCUC in accordance with its decision on the Application.

7.       Creative Energy is directed to file with the BCUC, within 10 days of the date of this order, amended tariff pages in accordance with the terms of this order.

Creative Energy Northeast False Creek Rate Proposal and 2021 Revenue Requirements Application

On November 30, 2020, Creative Energy filed its Northeast False Creek (NEFC) Rate Proposal and 2021 Revenue Requirements Application (RRA) to the British Columbia Utilities Commission seeking interim and permanent approval to increase NEFC hot water service rates by 10 percent (Application).

 

By Order G-340-20, the Panel approved the 10 percent rate increase on an interim and refundable/recoverable basis. In addition, the Panel established a regulatory timetable, which includes a request for affected customers and registered interveners (Affected Parties) in the Creative Energy 2019-2020 RRA for the Core Steam System and NEFC Service Areas proceeding to provide comments, if any, on the Application and submissions from Creative Energy and the Affected Parties on what, if any, regulatory process for the review of the Application would be appropriate and why.
