Operating Agreement between the City of West Kelowna and FortisBC Energy Inc.

ORDER

WHEREAS:

 

A.      On November 28, 2024, FortisBC Energy Inc. (FEI) filed an application (Application) to the British Columbia Utilities Commission (BCUC) for approval of an operating agreement dated November 27, 2024, between the City of West Kelowna and FEI (FEI-West Kelowna Operating Agreement), pursuant to section 23(1)(g) of the Utilities Commission Act (UCA);

B.      FEI requests that, if approved by the BCUC, the FEI-West Kelowna Operating Agreement should have an effective date on the first of the month following at least four weeks after approval to allow for implementation on customer bills;

C.      On December 11, 2024, the BCUC issued BCUC Staff Questions No. 1 to FEI;

D.      On December 23, 2024, FEI filed its responses to BCUC Staff Questions No. 1; and

E.       The BCUC has reviewed the Application and FEI’s responses to BCUC Staff Questions No. 1 and determines that the establishment of a public hearing process is warranted.

 

NOW THEREFORE the BCUC orders as follows:

 

1.       A public hearing process and a regulatory timetable are established, as set out in Appendix A to this order.

2.       As soon as is practicable but no later than Friday, January 17, 2025, FEI must publish the public notice attached as Appendix B to this order on its website at www.fortisbc.com and existing social media platforms.

3.       FEI must provide written confirmation of compliance with Directive 2 of this order to the BCUC by Wednesday, January 22, 2025, including a list of the social media platforms on which the public notice has been published.

4.       Parties who wish to participate in the proceeding may submit a letter of comment by Thursday, February 6, 2025. Letters of comment must be in the Letter of Comment Form available on the BCUC’s website at https://www.bcuc.com/Forms/LetterOfComment.https://www.bcuc.com/Forms/LetterOfComment.

FEI Operating Agreement between West Kelowna and FEI

On November 28, 2024, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission for approval of an operating agreement with the City of West Kelowna. The operating agreement between both parties outlines the terms of administering and operating gas distribution facilities within the City of West Kelowna, and will result in a new fee of 3% of gross revenues to be collected from customers in the City of West Kelowna.
