ORDER

WHEREAS:

 

A.      On November 28, 2025, Corix Burnaby Mountain DE Limited Partnership (Corix) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval of its Burnaby Mountain District Energy Utility (BMDEU) revenue requirements and rates for 2026 and 2027 (Application);

B.      The BMDEU delivers thermal energy service to two distinct customer groups:  Simon Fraser University  (SFU); and the UniverCity neighbourhood, a residential and commercial property development on Burnaby Mountain, adjacent to the SFU campus (UniverCity);

C.      By Orders G-348-24 dated December 19, 2024 and G-18-25 dated January 28, 2025, the BCUC approved, among other things, permanent rates for SFU and UniverCity, effective March 1, 2024 and January 1, 2025;

D.      In the Application, among other things, Corix requests BCUC approval of the following proposed rates for 2026 to 2027, effective January 1 of each year:

E.       In the Application, Corix also requests interim approval, on a refundable or recoverable basis, of the proposed rates effective January 1, 2026 for SFU and UniverCity which are set out in the rate schedule filed in Section A of Appendix E to the Application for SFU and in the rate schedule filed in Section C of Appendix F to the Application for UniverCity; and

F.       The BCUC has commenced review of the Application and considers the following determinations are warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 and 89 of the UCA, the BCUC orders as follows:

 

1.       A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.

2.       The following rates are approved on an interim, refundable or recoverable basis, effective January 1, 2026:

a.       For SFU:

                                                   i.      Capacity Charge of $22,354 per megawatt of nominated capacity per month;

                                                 ii.      Consumption charge of $0.0271 per kilowatt-hour; and

                                               iii.      Availability Charge of $33,000 per month.

b.       For UniverCity, a Basic Charge of $1.7178 per square metre per month.

3.       Any variance between the interim and permanent rate, as determined by the BCUC following its final decision on the Application, is subject to refund to or recovery from customers, with interest to be determined by the BCUC.

4.       The rate schedule for UniverCity set out in Appendix F of the Application is accepted for filing.

5.       Corix is directed to amend the proposed rate schedule for SFU included in Appendix E of the Application to indicate that for 2027, the Capacity Charge, Consumption Charge, and Availability Charge are proposed rates and subject to BCUC approval. Corix is directed to file this amended rate schedule as a tariff page for endorsement by the BCUC by Thursday, December 18, 2025.

6.       On or before Thursday, December 18, 2025, Corix is directed to:  

                  i.               Provide notice of the Application and this order, or post the Public Notice attached as Appendix B to this order, on Corix’s website and its existing social media platforms. Corix must publish social media monthly reminder posts during the first week of each month until the conclusion of the letters of comment period;

                ii.               Provide a copy of this order and the Public Notice attached as Appendix B to this order, electronically where possible, to all customers of the BMDEU and registered interveners in the Corix Burnaby Mountain DE Limited Partnership Burnaby Mountain District Energy Utility 2024–2025 Revenue Requirements and Rates proceeding; and

              iii.               Request each UniverCity customer to post the Public Notice attached as Appendix B to this order on major notice boards of the customer’s buildings served by the BMDEU and request each customer to provide confirmation of this posting to Corix.

7.       Corix is directed to provide to the BCUC:

                  i.               Confirmation of compliance with Directive 6’s public notice requirements, except for the monthly social media reminder posts, including a list of all parties notified and a list of the social media platforms on which public notice was provided, in accordance with the regulatory timetable; and

                ii.               Confirmation of compliance with Directive 6’s public notice requirement regarding monthly social media reminder posts in accordance with the regulatory timetable.
